PRAYER :- For Bail in Crime No.261 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 30.08.2022 for the offence under section 8(c), 20(b)(ii)(C) and 29(1) of NDPS Act in Crime No.261 of 2022 on the file of the respondent police seeks bail.

2.The case of the prosecution is that on secret information, the Sub-Inspector of Police on 30.08.2022 proceeded to Uppan River Bed, Akkaraikulam and mounted surveillance. At 09.00 hours, the petitioner along with other accused came there and on seeing the police party, they tried to escape from there. However, the police party caught them and recovered one gunny bag from them, in which, 21 kgs of ganja found. Hence the case.

3.Heard both sides and perused the materials available on record including the First Information Report. 4.It is seen that this is second petition for bail and the first petition was dismissed only on 10.04.2023. There is no change in circumstances. Hence, this Court is not inclined to grant bail to https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD)No.10725 of 2023 the petitioner. Accordingly, this criminal original petition is dismissed. However, the Court below is directed to complete the trial in C.C.No.12 of 2023, within a period of six months from the date of receipt of a copy of this order.
