ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 294(b), 323, 506(1) of IPC and section 4 of Women Harassment Act, in Crime No.260 of 2022 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the defacto complainant worked as an accountant in the Society namely Yadhava Cultural Association and he was removed from the job in the month of April. The society has not paid salary to the defacto complainant, over which, the defacto complainant went to the office and claimed her monetary benefits. At that time, at the instigation of the first accused, the petitioners abused the defacto complainant in filthy language and also threatened him with dire consequence. Based upon the above said occurrence, the present complaint has been registered against the petitioners.
3. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) appearing for the respondent police.
4.The learned counsel for the petitioners submitted that as per the direction of this Court, the accused persons sent the salary to the defacto complainant for the month of April 2022 through Demand Draft.
5.The learned counsel for the intervenor submitted that the intervenor has received the demand draft.
6.Considering the above said development, this Court is inclined to grant bail to the petitioners, however, with stringent conditions.
7.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or their appearance, before the learned Judicial Magistrate No.VI, Madurai, and on their executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only)each, with two sureties, each for a like sum to the satisfaction of the learned Magistrate concerned; and the petitioner shall appear before the respondent police once in a month i.e., on first Monday of every English Calender Month at 10.30 a.m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
8.The petitioners shall appear before the concerned Magistrate within a period of fifteen days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
