ORDER
This Writ Petition has been filed by 189 Sanitary Workers, seeking indulgence of this Court to direct the respondents 1 and 2 to classify the land in New S.Nos.F-1/58, F-1/67 and F-1/70, Agasteeswaram Taluk, Kanyakumari District, as Natham Poramboke, and consequently, to direct the seventh respondent to provide house site Pattas to the petitioners residing in the abovementioned lands, within a time frame to be stipulated by this Court.
2. Heard the learned Senior Counsel appearing for the petitioners, the learned Additional Government Pleader appearing for respondents 1 to 3 and 5 to 7, and the learned Standing Counsel appearing for the fourth respondent.
3. It is the specific case of the fourth respondent / Corporation that the lands belong to the Corporation and that the requests made by the petitioners were already rejected on three earlier occasions, namely, on 02.12.1997, 11.12.2019 and 23.12.2020. Instead of challenging the said rejection orders, the petitioners have approached this Court by filing the present writ petition.
4. The learned Senior Counsel appearing for the petitioners submits that the petitioners have been living in the premises for about 75 years, spanning three generations, and seeks consideration of the request for grant of Pattas in view of G.O.(Ms)No.97, Revenue and Disaster Management [LD-1(1)] Department, dated 21.02.2025.
5. The learned Standing Counsel appearing for the fourth respondent submits that the said Government Order would not apply, as the classification of land under the said Government Order pertains to unobjectionable Poramboke land, whereas the lands in question are Corporation lands, and the residential structures belong to the Corporation. It is further submitted that the petitioners were residing in the said premises as tenants.
6. The learned Senior Counsel appearing for the petitioners confines the prayer to a direction to consider the request for grant of Pattas in view of G.O. (Ms)No.97, Revenue and Disaster Management [LD-1(1)] Department, dated 21.02.2025.
7. Considering the aforesaid submissions, the writ petition is disposed of, by directing the respondents to consider the request for grant of Pattas in the light of G.O.(Ms)No.97, Revenue and Disaster Management [LD-1(1)] Department, dated 21.02.2025. It is left open to the respondents to determine whether the grievance of the petitioners falls within the scope of the said Government Order and to pass appropriate orders accordingly. No costs. Consequently, connected Miscellaneous Petition is closed.
