This Writ Petition has been filed to direct the second respondent herein to receive the application of the petitioner in respect of vehicle bearing Registration No. TN 99 B 0835 (TATA SFC 407/31) for Cancellation of Hypothecation, for Renewal of Fitness Certificate, receive the tax and effect the same forthwith on the basis of the petitioner's representation dated 20.06.2019. 2.The petitioner is a Contract Carriage operator with license to ply on all roads of entire Tamil Nadu and he has purchased the vehicle bearing registration No.TN 99 B 0835 from Coimbatore West along with permit. He filed an application to transfer the ownership of vehicle in his favour. The first respondent effected the same on 27.07.2015. Since the Fitness Certificate has expired on 08.02.2019, the petitioner made an application on 09.02.2019 for renewing the same and for the purpose of getting fitness certificate, he kept the https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P(MD)No.15590 of 2019 vehicle ready for inspection. But the fitness certificate was not issued for the reason that there is some block in the system at Regional Transport Office, Coimbatore. The respondent refused to receive the fees as well as application for getting renewal of fitness certificate. Aggrieved over the same, the petitioner has approached this Court.
3.The learned Special Government Pleader on instructions would submit that the said block at Regional Transport Office, Coimbatore was released on 21.10.2019 and it is open to the applicant to make application for renewal of fitness. She also produced a photo copy of the letter written by the Regional Transport Officer, Tuticorin to the Government Pleader, Madurai Bench of Madras High Court, dated 22.10.2019.
4.The proceedings in R.No.29617/C2/2019, dated 22.10.2019 is taken on file. From this communication, it could be inferred that the petitioner was made to wait unnecessarily on trivial issue. When the process has become system managed the transaction are made online, there shall be some provision for setting right all the anomalies manually also. But without taking any effective steps, in this regard, the petitioner was made to wait. 5.However, considering the long wait, a direction is given to the respondents to process the application to be made by the petitioner receive the fee and issue appropriate orders in accordance with law within a period of one week from the date of receipt of a copy of this order. No costs.
