ORDER : The Court made the following order : The petitioner, who was arrested and remanded to judicial custody on 25.10.2020, in connection with the case registered in Crime No.2361 of 2020 for the offence punishable under Sections 8(c) r/w 20(b)(ii)(C), 25, 29(1) of NDPS Act, has filed this application seeking bail.

2. The prosecution case is that on a secret information, the defacto complainant stopped a silver color Maruti Swift car, bearing registration no.TN-38-AQ-4151 at Madakulam main road, Madurai and found that the petitioner and another person transported two yellow color gunny bags, with 21 kgs of Ganja each (totalling 42 kgs of Ganja). Hence, the complaint.

3. Learned Counsel for the petitioner submitted that the petitioner is an innocent and has not committed any offence as alleged by the prosecution. However, a false case has been foisted as against him and therefore, prays for grant of bail.

4. Learned Additional Public Prosecutor, on instructions, submitted that apart from this case, the petitioner is having twelve previous cases to his credit, of which, five cases are for the offence u/s 307 IPC, one case is for the offence u/s 302 IPC, one case is for the offence u/s 397 and 392 IPC.

5. Considering the nature of allegation and the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
