ORDER

(Order of the Court was made by M.M.SUNDRESH, J.) The Writ Petition has been filed alleging that the private respondent, namely, respondent No.5 is putting up un-authorised construction beyond the assigned patta given in her favour. 2.Learned Standing Counsel for the respondents 3 and 4 submitted that on inspection, it was found to be an un-authorised construction by encroaching public road. On such circumstances, the fourth respondent has issued a notice on 07.01.2021, stating that the un-authorised construction will have to be removed. 3.In view of the subsequent development, we direct the respondent No.4 to conclude the aforesaid proceedings by following due process of law. It is needless to say that the 5th respondent's reply has to be considered before passing the order. The 5th respondent is directed to give reply to the notice within two weeks from the date of receipt of a copy of this order. Till appropriate orders are passed by the fourth respondent, the fifth respondent's possession shall not be disturbed.

4.The Writ Petition is disposed of with the above directions. Consequently, connected Miscellaneous Petition is closed. No costs.
