PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 6 to consider the petitioner's representation dated 30.05.2025 regarding closure of illegal cracker shops in Usilampatti operating without license by the respondents 7 and 8 and take appropriate legal action under the Explosives Act, 1884 and Explosives Rules, 2008.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ of Mandamus has been instituted to direct the respondents 1 to 6 to consider the representation of the petitioner dated 30.05.2025. 2.Mere direction to consider the representation would do no service to the cause of justice. The person, approaching the Court seeking such a direction, must establish that his rights are violated or the provisions of any of the statutes or rules have been violated. In the absence of any such ground, the Writ may not be entertained.

3.In the present case, the learned counsel appearing for the petitioner would submit that the respondents 7 and 8 are running illegal cracker shops in Usilampatti and operating the same without any license. However, the learned Government Pleader appearing for the respondents 1 to 4 has furnished written instructions, which would reveal that the respondents 7 and 8 have obtained license from the competent authority.

4.The petitioner is also unable to establish that any of the provisions of the Explosives Act or any other relevant statutes or rules have been violated. That being the factum, the petitioner has not raised any acceptable ground for the purpose of entertaining this Writ Petition. Accordingly, this Writ Petition stands dismissed. No costs.
