PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records in pursuant to the impugned order passed by the 2nd respondent in Ka.No.06/22/U.Po. (Pa.Pi - II) / dated 01.07.2022 and quash the same and consequently direct the respondents to extent the fishery rights lease for further period in accordance G.O.Ms.No.201, Animal Husbandry, Dairying and Fisheries Department, dated 19.10.2017, in respect of Poovaneri Tank, Solaiseri Village, Rajapalayam Taluk, Virudhunagar District.

ORDER

The present writ petition has been filed challenging the order passed by the second respondent herein wherein the request of the petitioner for extension of fishery rights lease for further period in accordance with G.O.Ms.No.201, Animal Husbandry, Dairying and Fisheries Department, dated 19.10.2017 was rejected.

2. A perusal of the impugned order reveals that the petitioner has enjoyed the fishery rights from 2018 to 2021 for a period of three years. His rights have got terminated on 30.06.2021. Thereafter, the petitioner has approached this Court in W.P.(MD)No.10814 of 2021 seeking extension. Based upon the orders passed by this Court, his rights were extended upto 30.06.2022. Thereafter, the petitioner had made another request for further extension. This request has been rejected under the impugned order.

3. In view of the fact that the petitioner's licence period has expired in 2021 and his extension order has also expired on 30.06.2022, the petitioner does not have any legal right to seek extension of lease for fishery rights. It is open to the concerned authorities to go for a public auction.
