Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent to dispose the appeal petition, dated 25.03.2019 preferred by the petitioner u/s. 5 of the TNPSS (D & A) Rules, against the punishment order passed by the 2nd respondent in his proceedings dated 28.02.2019 within the period that may be stipulated by this Court.

ORDER

This Writ Petition has been filed for issuing a direction to the 1st respondent to dispose the appeal petition, dated 25.03.2019 preferred by the petitioner u/s. 5 of the TNPSS (D & A) Rules, against the punishment order passed by the 2nd respondent in his proceedings, dated 28.02.109

2. Mr.A. Muthukaruppan, learned Additional Government Pleader takes notice for the respondents. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

3. Challenging the punishment order issued by the 2nd respondent, dated 28.02.2019, the petitioner has preferred an appeal dated 25.03.2019, before the first respondent. So far, no order has been passed in the said appeal. Hence, the petitioner has filed the present Writ Petition before this Court.

4. The learned Additional Government Pleader appearing for the respondents would submit that the appeal will be disposed of by the first respondent on merits and in accordance with law, within the time limit to be fixed by this Court.

5. Heard the learned counsel appearing on either side and perused the materials available on record.

6. Considering the limited scope of the prayer sought for by the petitioner, this Court, without going into the merits of the case, directs the first respondent to dispose of the petitioner's appeal dated 25.03.2019, pending on its file, on merits and in accordance with law, as expeditiously as possible, in any event not later than three months from the date of receipt of a copy of this order, after affording due opportunity of hearing to the petitioner.

7. With the above direction, this Writ Petition is disposed of. No costs.
