Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of writ of certiorari calling for the records relating to the proceedings of the respondent herein viz. the order dated 22.10.2016 in Na.Ka.No.E4/33289-2/2015 and quash the same. ORDER

The order under challenge in this writ petition is with regard to temporary suspension of the license granted to the petitioner to run fireworks business.

2. It is now seen that the period of licence itself had expired during the month of March, 2018 and as such, it would not be appropriate to pass any orders on the present prayer sought for. Nevertheless, it is represented by the learned senior counsel for the petitioner that the petitioner now intends to make an application for renewal of the original license.

3. Since the earlier impugned order was only in respect of temporary suspension of petitioner's license, it would be appropriate for the respondent to consider such an application intended to be submitted by the petitioner for renewal of license, without referring to the earlier suspension.

4. Accordingly, the petitioner is granted liberty to approach the respondent herein with fresh application for renewal of license to run fireworks business and on receipt of the same, the respondent shall consider the same on its own merits and in accordance with the procedures contemplated under the Explosives Act, without reference https://hcservices.ecourts.gov.in/hcservices/

to the earlier suspension order, dated 22.10.2016. Such an exercise shall be completed within a period of four weeks from the date of receipt of such a fresh application from the petitioner.

5. With the above directions, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
