Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the third respondent herein in K.No.013339/258/Ni.A/Ni.B.3/Oo.3/Goo.Va.Work/2023-1 dated 23.01.2025 and quash the same and consequently direct the 2nd 1/6

O R D E R

The instant writ petition has been filed by the petitioner challenging the rejection order of his compassionate appointment dated 23.01.2025 and consequently, to appoint the petitioner under compassionate appointment scheme.

2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

When the matter was taken up for hearing, the learned counsels on both sides, submitted that the issue involved in this writ petition is squarely covered by the order of this Court dated 06.06.2025 passed in W.P.(MD) No.2102 of 2025 (Princy Udhaya Vs. The Secretary to the Government of Tamil Nadu, Electricity Department). The 2/6

relevant portion of the order is extracted hereunder: "7. Considering the facts and circumstances of the case and in the light of the orders of this Court as stated supra and also taking into account, the submissions of the learned counsel for the petitioner that the petitioner has submitted the application on attainment of majority on 17.07.2023 on the next date of attaining majority and it is to be noted that the prescribed period of limitation is on 15.03.2023, which is not a longer period and further, considering the social and economic status of the family of the deceased, her claim for compassionate appointment deserves to be reconsidered. In view of the aforesaid reasons, the impugned orders passed by the third respondent dated 28.07.2023, 29.08.2023 and 31.08.

2023 are set aside and the matter is remanded back to the third respondent for a fresh consideration of the petitioner's application for compassionate appointment, on its own merits and in accordance with law. The third respondent shall pass appropriate orders in the light of the orders passed by this Court as stated supra, after affording an opportunity of personal hearing and by taking into account all relevant documents, within a period of six weeks from the date of receipt of a copy of this order.

In view of the above, the order impugned in the writ petition is set aside and the matter is remanded back to the third respondent for a fresh consideration of the petitioner's application for compassionate appointment, on its own merits and in accordance with law. The third respondent shall pass appropriate orders in the light of the orders passed by this Court as stated supra, after affording an opportunity of personal hearing of the petitioner and by taking into account all relevant documents, within a period of six weeks from the date of receipt of a copy of this order.
