Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 1st respondent to dispose off the Appeal, dated 08.06.2023, pending before the 1st respondent in respect of the lands covered in S.No.94/2B at Ayan Reddiyapatti Village, Manapparai Taluk, Trichy District, of an extent of 1.94.20 Hectares land, by

removing the name of 4th respondent from the patta No.3694 and issue separate patta in petitioner's name as per old patta No.204. For Petitioner :

ORDER

The petitioner herein seeks a direction to the first respondent to dispose of her appeal, dated 08.06.2023, in respect of the property situated in Survey No.94/2B at Ayan Reddiyapatti Village, Manapparai Taluk, Trichy District, seeking removal of the fourth respondent's name in Patta No.3694, pertaining to that property.

2. Heard Mr.T.R.Subramanian, learned counsel for the petitioner; and Mrs.K.Malathi, learned Additional Government Pleader, for the respondents 1 to 3. Since no adverse orders are passed against the fourth respondent, notice to her is dispensed with. With the consent of both the counsel, the Writ Petition is taken up for final disposal at the stage of admission.

3. It is the case of the petitioner that she got the above mentioned property under a settlement deed, executed by her mother, dated 13.06.2000.

Subsequently, exclusive patta was issued in the name of the petitioner vide patta No.204. Thereafter, the name of the fourth respondent was included in the revenue documents, behind the back of the petitioner. Therefore, the petitioner submitted an appeal before the first respondent on 08.06.2023, seeking deletion of the fourth respondent's name from the patta and restoration of exclusive patta in the name of the petitioner. The same has not been considered. Hence, the petitioner has come before this Court.

4. Learned Additional Government Pleader, who takes notice for respondents 1 to 3, would submit that the appeal submitted by the petitioner, dated 08.06.2023, would be considered on its own merits within a period stipulated by this Court.

5. In view of the same, without going into the merits of the claim made by the petitioner, the first respondent is directed to consider the appeal submitted by the petitioner on 08.06.2023 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of copy of this order, after issuing necessary notice to the petitioner and the fourth respondent.

6. Writ Petition is disposed of accordingly. No costs. 09.06.2025
