For Respondent : Mr.B.THANGA ARAVINDH Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.115 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 147, 148, 294(b), 324, 427, and 307 IPC in Crime No. 115 of 2022 on the file of the respondent police, seek/s anticipatory bail.
2. The case of the prosecution is that the defacto complainant lodged a complaint stating that on 02.05.2022 when the defacto complainant was returning to the house along with his brother at about 3.00 pm, in the opposite direction the accused persons came in a two wheeler and caused assault with Aruval and that he sustained injuries and also tried to kill his brother also. Hence, the complaint.
3. The learned counsel appearing for the petitioner submitted that only wordy quarrel ocurred between the accused persons and the defacto complainant and the petitioner is innocent he has not committed any offence as alleged by the prosecution.
4. The learned Government Advocate (Crl. Side) would submit that the petitioner is having 5 previous cases in which extortion case also pending. But, however, he has also involved in murder case in the year 2015 and it is pending before the trial Court. https://www.mhc.tn.gov.in/judis 1/2

Considering the bad antecedents reported against the petitioner and that if the petitioner is granted anticipatory bail he will continue to commit offences, the custodial interrogation of the petitioners is necessary. Therefore, this Court is not inclined to grant anticipatory bail to the petitioners.
