No.1420 of 2018 in STC NO.79/2016 dated 15/02/2019 on the file of the learned Judicial Magistrate, Theni, and direct the learned Judicial Magistrate, Theni, to consider the petitioner's recall petition and permitting his to cross examine the PW.1 in any date.

2. When the matte is taken up for hearing, there is no representation for the petitioner.

3. Considering the oldness of the crime, a report is called for from the learned Judicial Magistrate, Theni, as to the stage of the trial process.

4. List the matter on 03/12/2021 after receiving the report for final disposal."
