PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to consider the petitioner's representation dated 14.02.2019 to issue the certificate of Kisan Samania Nithi Scheme to his lands situated at Puthambur Village, Karur Taluk and District. ORDER

This Writ Petition is filed to direct the second respondent to consider the petitioner's representation dated 14.02.2019 to issue the certificate of Kisan Samania Nithi Scheme to his lands situated at Puthambur Village, Karur Taluk and District. 2.Heard Mr.P.Muthusamy, learned counsel appearing for the petitioner and Mr.P.Kannithevan, learned Special Government Pleader appearing for the respondents.

3.According to the petitioner, the petitioner has made a representation dated 14.02.2019 to the first respondent to sanction a sum of Rs.6,000/- every year under PM KISAN SAMANIA NITHI. The said representation was forwarded to the third respondent and the same is pending for consideration. He has also enclosed necessary documents as required by the respondents. Since the third respondent has not chosen to consider the petitioner's representation, the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.15932 of 2019 petitioner is before this Court.

4.The learned Additional Government Pleader appearing for the respondents would submit that admittedly, the patta stands in the name of the petitioner's father. After the demise of the petitioner's father, the said patta has not been changed in the name of the petitioner. He would further submit that there is a dispute with regard to the said property and a civil suit is also pending. 5.Considering the submission made by the learned Additional Government Pleader, this Court is not inclined to grant any relief to the petitioner at this stage, since civil suit is pending. Accordingly, this Writ Petition stands dismissed. However, it is open to the petitioner to approach the appropriate forum for getting the appropriate relief. No costs.
