For Respondent : Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.191 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/A3 & A4 who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 294(b), 323 and 506(i) of I.P.C., in Crime No.191 of 2023 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that due to money transaction dispute between the parties, the petitioners and other accused assaulted the de-facto complainant with bare hands and threatened him with dire consequences. Hence, the case.

3.Heard. Perused the materials available on record including the First Information Report.

4.It is submitted by the learned Government Advocate (Crl. side) that the first petitioner was already arrested and released on https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.10587 of 2023 station bail. Insofar as the second petitioner is concerned, he is a history sheeted rowdy and is having three previous cases. 5.Since the first petitioner was already arrested and released on station bail, this petition is dismissed as infructuous in respect of the first petitioner is concerned. 6.Considering the above facts and circumstances of the case and also the facts that the second petitioner is a history sheeted rowdy and he is having three previous cases and his custodial interrogation is very much required in this case, this court is not inclined to grant anticipatory bail to the second petitioner. 7.Hence, this petition is dismissed.
