ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 12 of POCSO Act and Section 506(ii) I.P.C, in Crime No.14 of 2018, seeks anticipatory bail.
2.The case of the prosecution is that on 24.08.2018, when the defacto complainant was going to employment office, the petitioner had followed and stated that he is loving her and instructed to marry him. He also threatened her that he would kill her if she refuses to marry him. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit the the petitioner is an innocent. He did not commit any offence as alleged by the prosecution. Hence, he prays for anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner is giving love torture to the defacto complainant, who is aged about 17 years. 5.Considering the nature of allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. In this circumstances, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw the Criminal Original Petition. He has also made an endorsement to that effect. Accordingly, this Criminal Original Petition is dismissed as withdrawn.
