Respondents Prayer: This Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the respondent No.3 from interfering with the petitioner's right of worship, profess and practice his religious faith of Christianity by way of prayer meetings in the Prayer House in the name of the Church of Pentecost (India) situated in Survey Nos.7/6A, 7/7, Door No.48/49, S.S.Nagar, Thiyagarajapuram, Narasinganpettai, Thiruvidaimaruthur Taluk, Thanjavur District.

ORDER

This Writ Petition has been filed to forbear the respondents from interfering with the petitioner's right to conduct prayer meetings in the Prayer House at a Church situated at Narasinganpettai Village.

2. It is the case of the petitioner that the petitioner has a right to conduct the prayer meeting in the Prayer House and it is a fundamental right guaranteed under the Constitution.

3. The learned Government Advocate appearing for the respondents would submit that a complaint was received in this regard by the third respondent and C.S.R. is pending in C.S.R.No.314 https://hcservices.ecourts.gov.in/hcservices/

of 2017. The third respondent immediately on receipt of the said complaint made a representation to the Sub Collector, Kumbakonam Division, to call the parties and conduct the Peace Meeting. This request was made by the third respondent by his letter dated 10.10.2017. However, till date no Peace Committee Meeting has been conducted by the Sub Collector.

4. In view of the above, there shall be a direction to the Sub Collector, Kumbakonam Division, Kumbakonam to call the parties and hold the Peace Committee Meeting in terms of requisition made by the third respondent, by his letter dated 10.10.2017. The Sub Collector, Kumbakonam Division is further directed to arrive at a decision after the Peace Committee Meeting within a period of one month from the date of receipt of a copy of this order.
