Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 23.03.2018 and 05.07.2019 in the light of the orders passed by the 1st respondent dated 03.05.2017, before finalzing the panel list released by the 1st respondent dated 02.07.2019 and fix the petitioner in the appropriate place in the Seniority List for the Post of Block Development Officer.

ORDER

This writ petition has been filed for issuing a direction to the respondents to consider the representations of the petitioner dated 23.03.2018 and 05.07.2019, in the light of the orders passed by the 1st respondent, dated 03.05.2017, before finalizing the panel list released by them, dated 02.07.2019 and fix the petitioner in the appropriate place in the Seniority List for the Post of Block Development Officer.

2. Mr. A. Muthukaruppan, learned Additional Government Pleader takes notice for the respondents. By the consent, the writ petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, the panel for promotion to the post of Block Development Officer has been published on 02.07.2019 and objections have also been invited for the said panel https://hcservices.ecourts.gov.in/hcservices/

if any, within a period of fifteen days, to the District Collector. The petitioner made an objection on 05.07.2019, but, so far no order has been passed. Hence, the petitioner has filed the present Writ Petition before this Court.

4. The learned Additional Government Pleader appearing for the respondents submitted that the respondents would consider the said representation and pass appropriate orders, on merits and in accordance with law, within a time frame to be fixed by this Court.

5. Having regard to the limited scope of the prayer made by the petitioner and considering the submissions made on either side, this Court, without expressing any opinion on the merits of the petitioner's case, directs the respondents to consider the representation of the petitioner, dated 05.07.2019, on merits and in accordance with law and pass appropriate orders, as expeditiously as possible, before publishing final list for promotion to the post of Block Development Officer, after affording due opportunity of hearing to the parties concerned.

6. With the above direction, the writ petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
