Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the second respondent and third respondent to give adequate Police Protection on the basis of the order passed by the first respondent in Na.Ka.No.24/2017/E1, dated 06.02.2017 and permit petitioner's association for conducting 'Cock Fight' at near Ayyanar Kovil in Villar Bye-pass on 11th and 12th February 2017.

ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the third respondent to give adequate police protection in pursuance of the order dated 06.02.2017 passed by the first respondent in Na.Ka.No.24/2017/E1, by way of issuing a writ of mandamus.

2.Mr.D.Muruganandam, learned Additional Government Pleader, has taken notice for the respondents.

3.It is seen from the records that the first respondent by virtue of the order dated 06.02.2017 passed in Na.Ka.No.24/2017/E1 has granted permission for conducting cock fight on 11th and 12th of February, 2017. Further it is seen from the impugned order that the first respondent has directed the police authorities to give necessary police protection.

4.The main grievance expressed on the side of the petitioner is that the third respondent has failed to give police protection.

5.As adverted to earlier, the concerned cock fight in the place mentioned in the petition is going to be conducted on 11th and 12th of this month.

6.Considering the aforesaid factual circumstances, this writ petition has been filed only on the basis of future cause of action and the same is not legally maintainable and therefore the same deserves to be dismissed.
