PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the second respondent not to harass the petitioners without following the due process of law based on the representation dated 06.07.2019.

ORDER

This petition has been filed seeking direction to the respondent police not to harass the petitioner.

2. The grievance of the petitioner is that based on the complaint given by the third respondent against the petitioner and another, the second respondent under the guise of conducting enquiry, is harassing the petitioner. Hence, the petitioner has filed the present petition.

3. Today, when the matter is taken up hearing, the learned Government Advocate (Crl.Side), on instructions, would submit that FIR has been registered against the petitioner in Crime No.159 of 2019 for the offence punishable under Sections 294(b), 324, 323 and 506(ii) IPC and the investigation on the same is pending. https://hcservices.ecourts.gov.in/hcservices/

3. Considering the facts and circumstances of the case and since FIR has been registered against the petitioner in Crime No.159 of 2019, the present petition is not maintainable. Accordingly, this Criminal Original Petition is dismissed.
