ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 1/3

20.06.2024 for the offences punishable under Sections 353, 307, 506 (ii) and 379 IPC and Section 21(1) and 21(2) of Mines and Minerals (Development and Regulation) Act, 1957, in crime No.152 of 2024 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner and other accused were illegally transported the river sand by using lorry and also attempted to murder the revenue official, who were intercepted the lorry. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 20.06.2024, hence he may be released on bail.

4.The learned Government Advocate (Crl. side) would submit that the investigation is yet to be completed and the District Magistrate / District Collector, Pudukkottai, Pudukkottai District, has passed the detention order in P.D.O.No.04/2024 on 08.07.2024, under Section 2(gg) of Tamil Nadu Act 14 of 1982, and detained the petitioner as 'Sand Offender'. Hence, he strongly opposed to grant bail.

5. Recording the submission of the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioner. 2/3
