* * * O R D E R Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the respondents 1 and 2.
2. Issuance of notice to the third respondent is dispensed with.
3. The third respondent had moved the second respondent for correction of the alleged UDR error. The petition was taken on file and enquiry notice was issued. The petitioner received the enquiry notice. He however could not attend the enquiry. He therefore sent a request letter seeking adjournment. In fact, more than one letter was sent by the petitioner herein. The grievance of the petitioner herein is that without accepting his 2/4
3 W.P.(MD)NO.15081 OF 2024 request, the second respondent had reserved orders in the matter. In this background, the present writ petition came to be filed.
4. I am satisfied that the petitioner has shown his bonafides . He is entitled to the opportunity of hearing. The petitioner's counsel states that the petitioner will appear before the second respondent on 22.07.2024 at 3.00 p.m. The second respondent will issue notice to the third respondent about the listing of the proposed hearing date on 22.07.2024 at 3.00 p.m. If the said date and time is not convenient to the second respondent, it is open to the second respondent to intimate the petitioner and the third respondent accordingly. Whatever the date to be given by the second respondent, the petitioner will appear. The petitioner will no longer plead any inconvenience. After hearing the petitioner and the third respondent and after perusing the records, the second respondent will pass appropriate orders on merits and in accordance with law. I make it clear that I have not gone into the merits of the matter. All the contentions of both the parties are left open. This writ petition stands disposed of accordingly. No costs. 3/4
