Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorari to call for the records from the 1st respondent labour Court, Tirunelveli, relating to the impugned award passed by it in I.D.No.61 of 2011 dated 16.04.2012 and quash the same.

ORDER

The Management of Tamil Nadu State Transport Corporation, Tirunelveli, represented by the General Manager has filed the writ petition challenging the award in I.D.No.61 of 2011 dated 16.04.2012 passed by the labour Court, belatedly. However, no reason whatsoever has been given to condone the huge unexplained delay of more than four yeas. When the petitioner, who is a responsible Officer, has to act against any order passed against the Transport Corporation.

2. In the present case, the petitioner has been conducting the case before the labour Court, Tirunelveli. After the award was passed on 16.04.02012, without taking any swift and active steps to challenge the correctness of the order, again has come to this Court, with the unexplained delay of more than four years. Therefore, this Court is not inclined to entertain the writ petition.

3. The writ petition fails and the same is, accordingly, dismissed. No costs. Consequently, connected Miscellaneous Petition in WMP No.9376 of 2016 is also dismissed. Sd/- Assistant Registrar (AE) /True Copy/ Sub Assistant Registrar RR To, The Presiding Officer, Labour Court, Tirunelveli.
