Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the 1st and 2nd respondents to give sanction for the proposal dated 12.04.2016 sent by the 3rd respondent Society for fixing salary for the petitioners as per 'B' Class Society norms in the light of Circular No.7/2014 dated 28.02.2014 and order in Na.Ka.17933/2013/Tho.Ve.Sa 1(1), dated 09.02.2016 passed by the Registrar of Co-operative Societies and consequently, direct the 3rd respondent Society to give salary to the petitioners as per the 'B' Class Society norms. O R D E R
The petitioners seek for a Writ of Mandamus, directing the first and second respondents to give sanction for the proposal dated 12.04.2016 sent by the 3rd respondent Society for fixing salary of the petitioners as per 'B' Class Society norms in the light of
Circular No.7/2014 dated 28.02.2014 and the order passed by the Registrar of Co-operative Societies in Na.Ka.17933/2013/Tho.Ve.Sa1 (1), dated 09.02.2016 and consequently, direct the 3rd respondent Society to give salary to the petitioners as per the 'B' Class Society norms.
2.The learned Special Government Pleader takes notice for the first and second respondents.
3.By consent, the writ petition itself is taken up for final disposal.
4.The learned counsel for the petitioners submitted that already a proposal dated 12.04.2016 has been sent by the 3rd respondent to the respondents 1 and 2 and hence, a suitable direction may be given to such respondents for sanctioning such proposal within a time frame.
5.The learned Special Government Pleader appearing for the respondent Nos.1 and 2, on instructions, would submit that the proposal dated 12.04.2016 with regard to the grant of salary as per 'B' class Society norms is pending before the second respondent and the same may be considered within the time stipulated by this Court. 6.In view of the submission made by the learned Special Government Pleader, without going into the merits of the matter viz., whether the petitioners are eligible to the salary and the same may be applicable to the employees of the third respondent / Society and whether the benefit of 'B' class Society norms could be granted to the third respondent, as the same have to be decided by the first and second respondents, the first and second respondents are directed to take a decision with regard to the proposal sent by the 3rd respondent and pass orders in accordance with law, within a period of two months from the date of receipt of a copy of this order.
7.With the above direction, this Writ Petition is disposed of. No costs.
