ORDER : The Court made the following order :- 1/4

The petitioner / accused, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 191(2), 191(3), 126(2), 296(b), 115(2), 351(3) of BNS, 2023 and r/w. Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002, in Crime No.435 of 2025 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that on 15.05.2025 at about 10.30 pm when the defacto complainant and his wife were at home, behind their house, they had heard loud and indecent conversation made by some persons. Hence, they were gone to the backside of the house and at that time, they had seen that the accused persons were drinking alcohol, when the same was questioned by the defacto complainant, the accused persons have abused him in filthy language. Hence, a case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case. Hence, he seeks anticipatory bail.

4. The learned Government Advocate (Crl side) appearing for the respondent - 2/4

Police submitted that no one has sustained injury in the said occurrence. He further submitted that the petitioner is a habitual offender and that there are 6 previous cases pending against the petitioner, which are similar in nature. He further submitted that investigation of the case is still pending and hence, he prays to dismiss this Criminal Original Petition.

5. Heard on both sides and perused the records.

Taking into consideration of the facts and circumstances of the case and the also the fact that the petitioner is a habitual offender and that there are 6 previous cases pending against the petitioner, which are similar in nature and also taking into consideration of the fact that the investigation of the case is in preliminary stage, this Court is not inclined to grant anticipatory bail to the petitioner.
