ORDER
The petitioner herein seeks a direction to the first respondent to dispose of the appeal preferred by him, dated 26.03.2025, seeking cancellation of the patta stands in the name of the third respondent in Patta No.1434 in respect of the property situated in Survey No.71/3, Ottutanpatti Village, Kayathar Taluk, Thoothukudi District. 2.Heard the arguments of Mr.N.Arjun Kumar, learned counsel appearing for the petitioner and Mrs.S.Jeya Priya, learned Government Advocate appearing for the respondents 1 and 2. Since no adverse order is passed against the third respondent, notice to the third respondent is dispensed with.
3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
4.It is the case of the petitioner that she purchased the subject property along with her husband from one Veluchamy and the same was registered as Document No.1967/94, on the file of Kadambur Register Office. According to the petitioner, the third respondent herein, by producing forged documents, obtained patta in his name in respect of the above mentioned property. Therefore, the petitioner preferred an appeal before the first respondent on 26.03.2025, seeking cancellation of the patta issued in favour of the third respondent. The same has not been considered till date. Hence, the petitioner has come before this Court. 5.The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the appeal submitted by the petitioner will be considered on its own merits, after issuing notice to the respective parties.
6.In view of the same, without expressing any opinion on the merits of the claim made by the petitioner, the first respondent is directed to consider the appeal preferred by the petitioner, dated 26.03.2025 and pass final orders on its own merits, within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and the third respondent. Accordingly, this Writ Petition is disposed of. No costs.
