ORDER : This Court made the following order :- The petitioner / Accused No.4, who was arrested and remanded to judicial custody on 27.05.2025 for the offences punishable under Sections 303(2) of BNS and section 21(1) of Mines and Minerals (Development and Regulation)Act, 1957 in Crime No.104 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 14.05.2025, the petitioner along with other accused persons were illegally transported 250 units of river sand by using tipper lorry and JCB without having any valid license or permit. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. The petitioner has falsely implicated in the case. The petitioner is ready and wiling to abide by any conditions imposed by this Court. He would further submit that the petitioner is in custody from 27.05.2025 nearly 8 days. Hence, he seeks bail.
4. The learned Government Advocate (Criminal Side) would submit that this petitioner and other accused persons were illegally transported 250 units of river 2/4
sand worth about Rs.25,00,000/-. In this case, other accused were absconded. This petitioner is having one previous case, which is similar in nature. In this case, investigation is at initial stage. Hence, he objected to grant bail to the petitioner.
5. Taking into consideration of the facts and circumstances of the case and considering the fact that the petitioner is having one previous case, other accused persons were absconded, the petitioner is in judicial custody only from 27.05.2025 and also considering the gravity and nature of offences, this Court is not inclined to grant bail to the petitioner.
