ORDER
This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and learned Government Advocate (Crl.Side) for the second respondent.
2. It is informed by the learned Government Advocate (Crl.Side) for the second respondent that the petitioner has been arrayed as A6 in Crime No. 19/2022 for the offences under Sections 379 IPC and Section 21(1) of the Mines and Minerals (Development and Regulations) Act, 1957 and further, submits that at the time of commission of offence, the petitioner was a minor.
3. It is submitted that the charge sheet has been made ready, however, it has not been filed before the concerned Court, namely, Juvenile Justice Board, Thanjavur.

4. Since no criminal case is pending as on date, there can be no impediment for directing the first respondent to issue passport to the petitioner.
5. Considering the same, there shall be a direction to the first respondent to issue passport to the petitioner. However, it is made clear that in case the charge sheet is filed, the petitioner shall hand over the passport with the concerned Court and thereafter, move a suitable application for retrieving the same as and when the petitioner proposes to travel abroad.
