PRAYER :-For Bail in Crime No.224 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested on 22.06.2022 for the alleged offences under Sections 436 and 307 of IPC, in Crime No.224 of 2022 on the file of the respondent police, seeks bail. 2.This is the second bail petition filed by this petitioner. Earlier bail petition in Crl.O.P(MD).No.11783 of 2022 was dismissed by this Court on 08.07.2022. While dismissing the bail petition filed by the petitioner, this Court made an observation that from the CCTV footage, the presence of the petitioner was verified and in the CCTV footage clearly shows that the petitioner was roaming in that area with an aruval and considering the gravity of the offence dismissed the bail petition.

3.On the ground of incarceration alone, this second bail petition has been filed by the petitioner.

CRL OP(MD). No.13006 of 2022 4.On perusal of CD file, it shows that the petitioner is aged about 50+, but in the bail petition his age was wrongly mentioned as 35.

5.Considering the facts and circumstances of this case and considering the age of the petitioner and the period of incarceration, this Court is inclined to grant bail to the petitioner with certain conditions.

6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Alangaulam, Tenkasi District, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 20/07/2022 / TRUE COPY / 20/07/2022 Sub-Assistant Registrar (C.S.)
