(Order of the Court was made by S.S.SUNDAR, J.) This Writ Petition is filed for issuance of a Writ of Mandamus, to direct the second respondent herein to issue Hindu ST-Kattunayakkan Community Certificates to the petitioner on surrendering the DNCThottiyanayakkar Community Certificate No.0881579, dated 16.06.2007 and issue fresh ST-Hindu Kattunayakkan Community Certificate to the petitioner's wife Sangeetha and his male child namely Sarvin in the light of the third respondent's proceedings in Na.Ka.No.B5/758/2018, dated 09.07.2018 within a stipulated time that may be fixed by this Court. 2.Heard Mr.P.Saravanakumar, learned counsel for the petitioner and Mr.T.Amjad Khan, learned Government Advocate for the respondents. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.
3.The learned Government Advocate appearing for the respondents fairly submitted that the petitioner's representation is yet to be disposed of on merits and it is in process. 2/4
4.The learned Counsel for the petitioner as well as the learned Government Advocate have stated that the facts involved in this case are similar to the Writ Petition in W.P(MD)No.15012 of 2022 and this Court, by order, dated 12.07.2022, has passed the following order: "5.In such circumstances, this Court, without expressing any opinion on the merits of the petitioner's claim either in the representation or in the affidavit filed in support of the petition, directs the second respondent to consider the representation of the petitioner and pass orders on merits and in accordance with law after following due process and after considering the materials produced by the petitioner. The entire exercise shall be completed by the second respondent within a period of twelve weeks from the date of receipt of a copy of this order." 5.In view of the above, this Writ Petition is also disposed of with the same directions. No costs.
