ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The writ petition has been instituted to direct the 1 to 3 to remove the encroachment made by the 4th and 5th respondents and others in the Government Puramboke land situated in Survey No.220/1 in Thonthilingapuram Village, Melur Taluk, Madurai District by considering the representation dated 27.08.2024.

2. The learned Government Pleader appearing for the respondents 1 to 3 would submit that the subject property in S.No.220/1 in Thonthilingapuram Village, Melur Taluk, Madurai District is identified as Government Poramboke.

3. Totally 14 persons have encroached upon the said land. In the event of identifying those persons as landless poor persons, the Government has to take steps to grant Patta to those people. It is needless to state that the eligibility criteria as contemplated under under RSO 21 (Revenue Standing Order 21) is to be followed scrupulously. Free land Patta is to be granted only to the landless poor people by ascertaining their eligibility to grant Patta.

4. In view of the fact that the Government has taken steps to grant Patta to the landless poor people, no further adjudication is required under the writ petition. However, in the event of taking decision not to grant Patta, then the authorities competent have to remove the encroachment by following the procedures.
