This Criminal Original Petition filed under Section 482 of Cr.P.C. To call for the records pertaining to the charge sheet in C.C.No.47/2018 on the file of the learned the District Munsif cum Judicial Magistrate, Ilaiyankudi, Sivagangai District in Crime No.15 of 2017 dated 10/11/2017 and quash the same.

CRL MP(MD). No.8288 of 2022 04.04.2022, and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.R.Anandharaj, Advocate for the petitioner and Mr.A.Albert Jamesh, Government Advocate , for the 1st respondent this Court made the following order:

This Court while passing an order in Crl.O.P.(MD).No.6158 of 2022 on 04.04.2022, directed the petitioners to pay a sum of Rs.5,000/- (Rupees Five Thousand only) to the credit of Government of Tamil Nadu, CMPRF in IOB, Secretariat Branch, Chennai-9, on or before 11.04.2022. But, the petitioner has not paid the aforesaid amount within the stipulated time.

2. The learned counsel for the petitioner submitted that the order dated 04.04.2022 in Crl.O.P.(MD).No.6158 of 2022 was uploaded in the web portal only on 12.04.2022 and thereby, the petitioner has paid the amount on 12.04.2022.

3. In view of the above, the delay is condoned and the petition is allowed.

4. The Registry is directed to mark the copy of the order to the concerned Judicial Magistrate.
