PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to remove the encroachment made by the 4th respondent in the public pathway situated in Survey No.508/36, Madapasalai Village, Aruppukottai Taluk based on the communication of the 2nd respondent dated 08.02.2025.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) With reference to the relief sought for in the present Writ Petition, the learned Special Government Pleader appearing for the respondents 1 and 2, based on the written instructions, would submit that notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 has been issued to the encroachers. 2.Thus, the Tahsildar / 2nd respondent is directed to follow all further procedures as contemplated under the Act and remove the encroachment if any identified. The entire exercise is directed to be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order. 2/4

3.With the above direction, this Writ Petition stands disposed of. No costs.
