ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 8(c) r/w 20(b)(ii)(B) of NDPS Act, 1985 in Crime No.332 of 2018, seeks anticipatory bail.
2.The case of the prosecution is that on 21.08.2018, based on the secret information, the defacto complainant, who is the respondent police had seized 1250 gms of kanja and Rs.600/- from the first accused. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit the the petitioner is the mother-in-law of the first accused. She is an innocent. She did not commit any offence as alleged by the prosecution. Hence, he prays for anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that based on the confession statement of the https://hcservices.ecourts.gov.in/hcservices/
first accused, this petitioner has been implicated in this case. There are three previous cases are pending against the petitioner, in which, one is similar in nature. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner. 5.Considering the bad antecedents of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioner.
