Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to pay the Petitioner pension payable to him for the period from October 2003 to February 2015 under TNSTCEPF Rules together with interest at 18% per annum.

ORDER

The Petitioner has come forward with this Writ Petition seeking to issue a Writ of Mandamus directing the respondents to pay the Petitioner pension payable to him for the period from October 2003 to February 2015 under TNSTCEPF Rules together with interest at 18% per annum.

2.Heard both sides.

3.When the matter is taken up for hearing, learned counsel for the respondents would submit that the Petitioner is entitled to the amount as claimed by him and the arrears of pension has also got to be paid from October 2003 to February 2015 together with interest at 6% p.a in the light of the order passed by the First Bench of this Court in similar matter in W.A(MD)Nos.383 to 457 of 2015, dated 12.6.2015. issuing direction to the transport corporations to settle the terminal benefits of its employees in equal monthly https://hcservices.ecourts.gov.in/hcservices/

instalments and to pay 6% interest on the terminal benefits payable to the Workmen and that the arrears of pension shall be paid in 12 equal monthly instalments.

4.In view of the above submission, the respondents/transport Corporation is directed to settle the arrears of pension payable to the Petitioner from October 2003 to February 2015 in 12 equal monthly instalments commencing from 1.11.2018. The first instalment is directed to be be paid on or before 02.11.2018. 5.With the above directions, the Writ petition stands disposed of. No costs.
