Sundarajan ...R-4 & R-5/Victims PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the I Additional District and Sessions Court (Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Trichy, to accept the surrender of the petitioner/accused and consider the petitioner bail application and grant bail on the date of surrender itself, in Crime No.684 of 2020 on the file of the second respondent police.

O R D E R

The petitioner is an Accused No.2 in Crime No. 684 of 2020 registered on the file of the Inspector of Police, Pettavaithalai Police Station, Trichy District, for the offences under Sections 294 (b), 324, 307 of IPC and Section 4 of Tamil Nadu Prohibition of Women Harassment Act, 2002 and Sections 3(1)(r), 3(1)(s), 3(2)(V) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

2. The learned counsel appearing for the petitioner reiterated the contentions set out in the original petition. 1/3

3. The learned Additional Public Prosecutor appearing for the respondent police has not raised any serious objection to allow the petition and on instructions, he would submit that the injured was already discharge from the hospital and there is no bad antecedents against the petitioner herein.

4. Considering the present times, notice to the respondent Nos.3 to 5 is dispensed with.

5. I am of the view that interest of justice will be served by permitting the petitioner to surrender before the learned I Additional District and Sessions Judge (Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities), Trichy, within a period of eight weeks from the date of receipt of a copy of this order. The learned I Additional District and Sessions Judge (Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities), Trichy, will dispose of the petitioner's bail petition on the same day of surrender on its own merits. There will be a direction to the respondents 1 and 2 not to arrest the petitioner till the expiry of the period of eight weeks.

6. This Criminal Original Petition is allowed on these terms.
