PRAYER :- For Anticipatory Bail in Crime No.289 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b) and 109 of BNS, 2023 in Crime No.289 of 2025 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that due to some dispute, on 27.04.2025, when the de-facto complainant contacted the petitioner over phone, the petitioner abused the de-facto complainant and also threatened him with dire consequences. Thereafter, on the very same day, the petitioner, along with other accused, went to the de-facto complainant's house with deadly weapons, and assaulted him and caused injuries. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. The de-facto complainant and the petitioner are close friends. On the date of occurrence, two F.I.Rs. were registered against the petitioner in Crime No.260 of 2025 and Crime No.289 of 2025 2/4

(the present case). In respect of Crime No.260 of 2025, the petitioner was arrested and later, on medical ground, he was released on bail. He further submitted that since the respondent police broken his legs, the petitioner is now taking treatment at the hospital. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that there are 4 accused persons in this case and the petitioner has been arrayed as A1. All other accused have been arrested and are still in custody. Injured has been discharged from the hospital on 28.05.2025. He further submitted that at the instigation of A1 only, other accused persons have attacked the de-facto complainant. Hence, he opposed to grant anticipatory bail to the petitioner.

Considering the facts and circumstances of the case, and considering the gravity of the offence, and considering the specific overt act against the petitioner, and also considering the fact that the co-accused are still in custody, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
