Prayer :- Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents 2 and 3 to measure demark the petitioner scheduled property in T.Survey No.260, Pillathurai Village, Musiri Taluk, Thathaiyangarpettai Sub Registrar District, Tiruchirapalli District, in the light of necessary payment paid by the petitioner, with the help of the 6th respondent to give adequate police protection till the completion of measuring the above said properties, within the stipulated time.

ORDER

The petitioner herein seeks a direction to the respondents 2 and 3 to survey the property situated in Town Survey No.260, Pillathurai Village, Musiri Taluk, Tiruchirapalli District.

2.Heard the arguments of M/s.P.Subha Rani, learned counsel appearing for the petitioner, Mr.M.Gangatharan, learned Additional Government Pleader appearing for the respondents 1 to 3 and Mr.M.Vaikkam Karunanithi, learned Government Advocate appearing for the respondents 4 to 6. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself. 3.It is the case of the petitioner that the above said property, with an extent of 1.89 acres, was purchased by the petitioner and two others under a registered sale deed dated 06.02.2023. Thereafter, the petitioner submitted an online application on 03.06.2025, seeking survey of the said land purchased by him. The petitioner has also paid necessary survey charges. However, the application of the petitioner has not been considered. Hence, he has come before this Court. 4.The learned Government Advocate appearing for the respondents 1 to 3 would submit that the petitioner made an application only on 03.06.2025 and the same will be considered in due course on its own merits.

5.In view of the same, without expressing any opinion on the merits of the claim made by the petitioner, the respondents 2 and 3 are directed to consider the application submitted by the petitioner dated 03.06.2025 in Application No.2025/0123/15/007288, relating to the survey of the property situated in Town Survey No.260 and pass final orders on its own merits, within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and other interested parties. Accordingly, this Writ Petition is disposed of. No costs.
