O R D E R

This Criminal Original Petition is filed seeking for a direction to the second respondent to comply with the order passed by the learned District Munsif cum Judicial Magistrate, Cheranmahadevi, dated 17.10.2022.

It is submitted by the learned counsel appearing for the petitioner that in respect of a dispute between the petitioner and the respondents 3 to 5, the petitioner has filed a complaint before the learned District Munsif cum Judicial Magistrate, Cheranmahadevi, who in turn, referred the matter to the Police to make preliminary enquiry on the allegation of the complaint and register the case, if the cognizable offence is made out during such enquiry.

3. It is submitted by the learned Additional Public Prosecutor appearing for the respondents that as per the directions of the trial Court, the Police initiated the enquiry and since there is an allegation of 2/5

ownership by both the petitioner and the unofficial respondents, the land was surveyed and a report has been filed before the trial Court on 17.04.2023.

4. Since it is a civil dispute between the parties and the report which is required to be filed before the trial Court has already been filed by the prosecution on 17.04.2023 itself, this Criminal Original Petition has become infructuous. Accordingly, this Criminal Original Petition is dismissed.
