PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to issue a look out notice for the second accused in Crime No.187/2023 on the file of the Chinnamanur Police station, Theni District.

ORDER

This Criminal Original Petition has been filed to issue a look out notice for the second accused in Crime No.187/2023 on the file of the Chinnamanur Police station, Theni District.

2. The learned Additional Public Prosecutor would submit that investigation is still pending. During the course of investigation, from the statement of witnesses, it came to be light that the second accused is living in Singapore, who is the required person.

3. It is the duty of second respondent, who is the Investigation Officer to conduct proper investigation to secure the second accused. It is for the first respondent to decide whether to issue look out notice. No specific direction can be issued to the second respondent to take up the investigation to a particular manner.

4. Further it is seen that steps also taken by the second respondent to ascertain the Passport number of the second accused. In this regard, 2/4

letter is also addressed. Investigation shall be taken on its own course. It is for the second respondent herein to decide the further course of action. No specific direction can be issued to the second respondent.

5. With the above said observation, this Criminal Original Petition stands disposed of.
