Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents No.1 to 5 to consider and pass appropriate orders on the representation dated 17.07.2016 sent by the petitioner for taking appropriate prosecution action against unauthorized banner erectors and also take action against 6th respondent for offence committed under section 166A, 110 and 217 of IPC. This petition has been filed seeking a direction to the respondents 1 to 5 to take action based on the representation dated 17.07.2016 sent by the petitioner through E-mail, addressed to the respondents 1, 4 to 6.
2.Mr.K.Chellapandian, learned Additional Advocate General takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal.
3.The learned Additional Advocate General appearing for the respondents would submit that the petitioner cannot take the law into his own hands and invite trouble for the administration. 4.The petitioner, party-in-person would submit that his representation dated 17.07.2016 is not considered by the authorities concerned.
5.A perusal of the materials would show that the complaint sent by the petitioner through E-mail has been addressed to the respondents 1, 4 to 6.
6.The learned Additional Advocate General appearing for the respondents would submit that the Inspector of Police, Tallakulam Police Station/sixth respondent herein, who is the jurisdictional police, will look into the complaint of the petitioner dated 17.07.2016 and take appropriate action in accordance with law.
7.Since several allegations have been levelled against the sixth respondent, it is not appropriate to direct the sixth respondent to look into the grievance of the petitioner. Hence, the Assistant Commissioner of Police, (L & O), Tallakulam Sub Division, Madurai is directed to enquire into the complaint of the petitioner dated 17.07.2016 and take suitable action in the manner known to law.
8.With the above direction, this Petition is disposed of. No costs.
