ORDER
The petitioner herein seeks a direction to the respondents to conduct survey of the property situated at S.No.496/47, Kattuparamakudi Revenue Village, Paramakudi Taluk, Ramanathapuram District.
2. Heard the arguments of Mr.D.Senthil, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader, who takes notice on behalf of the respondents.
3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
4. According to the petitioner, the aforementioned property is the ancestral property of the petitioner's father deceased Jegadeesan and his brother Kesavan. They got 16 1⁄2 cents in the aforementioned survey
number. Out of the said extent, 9.5 cents was sold to the third party and remaining 7 cents of land alone is available with the petitioner's family. Patta for the subject property was issued in the name of the petitioner's father, deceased Jegadeesan, who died on 14.08.2024 leaving behind the petitioner, his brother and sister. Now, the petitioner submitted an application through online on 26.06.2024 seeking survey of the aforesaid land, but the same has not been considered. Hence, the petitioner has come before this Court.
5. Mr.A.Baskaran, learned Additional Government Pleader, who takes notice on behalf of the respondents, would submit that as per the revenue records, the subject property stands in the name of the petitioner's father, deceased Jegadeesan and there are other legal heirs for the pattadhars.
6. In view of the above submission made by the learned Additional Government Pleader appearing for the respondents, without expressing any opinion on the merits of the claim made by the petitioner, this Court directs the first respondent to consider the online application of the
petitioner dated 26.06.2024 in application No.2024/0123/27/001549 and pass final orders on its own merits, within a period of eight (8) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, other legal heirs of the deceased Jegadeesan and other interested parties, if any.
