JUDGMENT

Heard the learned Additional Government Pleader for the appellants. None appears for the respondent / writ petitioner. 2.The petition mentioned vehicle of the respondent herein was seized on the ground that it was found in transporting PDS rice illegally. The respondent filed W.P.(MD)No.10077 of 2021. The learned Single Judge vide order dated 17.06.2021 directed the appellants to release the vehicle with certain terms and conditions. Questioning the same, this intra-court appeal has been filed.

3.We are of the view that the order passed by the learned Single Judge cannot be faulted. Only interim custody has been granted. The authority had been specifically given liberty to proceed with the confiscation proceedings. Therefore, we are of the view that the order passed by the learned Single does not in any way prejudice the authority. 2/4
