2. For the sake of convenience, the respondents are referred to by their names.

These writ petitions are filed, seeking to forbear the respondents or any other personnels authorized by them, from evicting or removing the Bunk Stall of the petitioners situate at Perumal Theppakulam West, Town Hall Road, Madurai - 625 001, till the disposal of the revision filed by the petitioners before the first respondent / Secretary, in accordance with law.

4. The case of the petitioners, as averred in the affidavit filed in support of the petitions, is that they are tenants under Koodal Alagar Temple and they have paid the rent regularly without any default. While so, based on the directions

issued by this Court in a suo-motu Public Interest Litigation, the Assistant Commissioner, HR & CE, has proceeded for eviction. Thereafter, the Joint Commissioner, HR & CE, vide his order, dated 12.11.2016, under Section 80(4) of the Tamil Nadu Hindu Religious and Charitable Endowments Act, directed the petitioners to vacate the premises and hand over the possession within 30 days. Challenging the said order, the petitioners have preferred appeals before the Commissioner, HR & CE. All the appeals were heard in common and the Commissioner, HR & CE, dismissed all the appeals. 4.1.According to the petitioners, the Commissioner, HR & CE, without appreciating the objections as well as the legal submissions made by the petitioners, had confirmed the order of eviction. Aggrieved over the same, the petitioners have filed revisions before the first respondent / Secretary, under Section 114 of the said Act.

4.2.Now, pending revision, the Assistant Commissioner, HR & CE, by order dated 27.11.2017, observing that the appeals preferred by the petitioners before the Commissioner, HR & CE, were dismissed, had directed all the petitioners to remove the encroachment and hand over the vacant possession to the Temple authorities on or before 14.12.2017, failing which, they will be evicted with the help of police force. Aggrieved over the same, the petitioners are before this Court.

The learned Senior Counsel for the petitioners would contend that the Assistant Commissioner, HR & CE, taking note of the pendency of the revision preferred by them before the first respondent/Secretary, ought not to have passed the impugned proceedings. He would place reliance on the order of this Court in W.P.No.32299 of 2017, decided on 13.12.2017, wherein, this Court, while considering the similar issue, had directed the authorities to maintain status-quo, till the disposal of the revisions by the first respondent.

6. The learned Senior Counsel further submitted that the present petitions also arose out of the same cause of action and therefore, prays for similar order, for which, there is no serious objections from the other side.

7. Heard the learned Counsel appearing on both sides and perused the documents placed on record.

It is seen that based on the interim directions issued by the Division Bench of this Court in W.P.(MD)No.1451 of 2011 (suo-motu Public Interest Litigation) on 24.10.2016, which is pending, the authorities of Koodal Alagar Perumal Temple had started vacating the encroachments, so as to restore the temple tank to its original position. It is also seen that in the earlier rounds of litigation, the Assistant Commissioner, HR & CE, has issued notices ordering eviction, which was challenged before this

Court, in W.P.(MD)No.2263 of 2014 and this Court had quashed the said notice, on the ground that as per Section 80 of the Hindu Religious and Charitable Endowments Act, the Assistant Commissioner is empowered to submit a report to the Joint / Deputy Commissioner, as the case may be and granted liberty to the authorities to initiate fresh proceedings, in the manner known to law. Thus, the Joint Commissioner has passed the order of eviction, which was challenged before the Commissioner and now, before the Secretary to the Government by way of revision.

9. Going by the submissions of the learned Senior Counsel, this Court feels it appropriate to extract the order passed in W.P.No.32299 of 2017, decided on 13.12.2017, which reads thus:

"...Therefore, without expressing any view on the merits and contentions raised by both parties, this writ petition is disposed of, by directing the first respondent to consider the revision filed by the petitioner dated 13.06.2017 and pass orders on the same on merits and in accordance with law, after giving due opportunity of hearing to the respective parties. Such exercise shall be done by the first respondent within a period of six weeks from the date of receipt of a copy of this order. Till an order is passed by the first respondent in the main revision, the respondents 3 to 5 shall maintain status quo as on today. The petitioner should cooperate with the first respondent for disposal of the revision within the time stipulated by this Court, without seeking for any adjournment."

10. No doubt, encroachments should not be permitted, at any cost, but, on the other hand, the petitioners herein claimed that they are tenants with the said Koodal Alagar temple administration and if they are evicted without any alternate arrangements, it would certainly cause damage to them.

11. This Court, keeping in mind the livelihood of the petitioners, had directed both the parties to suggest alternate arrangements and pursuant to the said direction, the respective learned Counsel for the petitioners have submitted an additional affidavit along with some proposal and they have also sent the same, in detail, to the Joint Commissioner HR & CE as well as the Assistant Commissioner, Koodal Alagar Perumal Temple.

Considering the facts and circumstances of the case, this Court, in the interest of justice and also keeping in mind the order in W.P.No.32299 of 2017, decided on 13.12.2017, directs the Assistant Commissioner, Koodal Alagar Perumal Temple to forward the representation of the petitioners along with a memo containing the proposal for alternate arrangements to the first

respondent / Secretary to the Government, Tourism, Culture and Religious Endowments Department, Government of Tamil Nadu, Chennai - 600 009 within a period of two weeks from the date of receipt of a copy of this order. On receipt, the Secretary / first respondent shall consider the same along with the pending revisions preferred by the petitioners and dispose of the same, within a period of four weeks thereafter, on merits and in accordance with law, after affording due opportunity of hearing to the petitioners and all other interested parties. Till such time, the respondents shall maintain status quo as on date.

13. With the above directions, all these writ petitions are disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
