No.897/2021 and subsequent Rectification Deed dated 07.02.2022, registered as Doc.No. 354/2022, SRO, Peravoorani on the basis of the Petitioners representation dated 27.03.2026.

ORDER

This writ petition is filed for a mandamus directing the respondents 3 and 4 to cancel the sale deed dated 12.03.2026 registered as Document Nos. 853 and 854 of 2026 or to confirm the pathway existed on the basis of the sale deed of the petitioner's dated 17.03.2021 registered as Document No. 897 of 2021 and the subsequent Rectification Deed dated 07.02.2022 registered as document No.354 of 2022 at the Office of the Sub Registrar, Peravoorani, based on the petitioner's representation dated 27.03.2026. 2.The above prayer itself clearly reflects the case of the petitioner. 3.I have also heard the learned counsel for the petitioner and perused the material records of the case.

4.From the very prayer made itself, it can be seen that the issue is entirely within the realm of the Civil Court and certainly not within the jurisdiction of this Sub-Registrar to enquire into all this and it has already been held by the Honourable Supreme Court of India in Satya Pal Anand Vs. State of M.P and others, that the Sub-Registrar has no power to cancel the registration deed which are already registered. This Sub-Registrar does not have the power to conduct a trial and give a declaration that the petitioner has a pathway with reference to the lands covered in the said documents. Therefore, keeping open the liberty of the petitioner to approach the competent civil Court, this writ petition cannot be entertained and as such the same is disposed of.
