O R D E R
This writ petition has been filed for a mandamus seeking for a direction to the second respondent to send the revised pension proposals in respect of all the petitioners based on G.O.(Ms) No.473, Revenue and Disaster Management Department, Services Wing [Ser8(1)] Section, dated 03.12.2018 to the Accountant General, Chennai, within a time specified by this Court.
2. The petitioners had given a representation to the respondents prior to the filing of this writ petition and the same has also been filed as a document along with this writ petition. However, the said representation was not considered by the respondents, which necessitated the petitioners to file this writ petition.
3. Learned Special Government Pleader appearing for the respondents would submit, on instructions, that the respondents are willing to consider the petitioners' representation, if the same is once again given seeking for the relief that has been sought for in this writ petition.
4. No prejudice will be caused to the respondents, if the petitioners are allowed to give a fresh representation to the respondents seeking for the relief that has been sought for in this writ petition and a direction is issued to the respondents to consider the said representation on merits and in accordance with law, within a time frame to be fixed by this Court.
5. For the foregoing reasons, this Court directs the petitioners to submit a fresh representation to the second respondent requesting him to forward their representation to the first respondent, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said representation from the petitioners, as stated supra, the second respondent shall forward the same to the first respondent, within a period of two weeks
thereafter and on receipt of the said representation, the first respondent shall pass final orders, on merits and in accordance with law, on the petitioners' representation, within a period of twelve weeks thereafter.
6. With the above directions, this writ petition is disposed of. No costs.
