PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the first respondent to instruct the second respondent not to harass in the guise of enquiry without authority or law.

O R D E R

This petition has been filed to direct the first respondent to instruct the second respondent not to harass in the guise of enquiry without authority or law.

2. The case of the prosecution is that one Pandi is the close relative of the petitioner and both the petitioner and the said Pandi involved in construction work. The wife of the said Pandi namely Priyadharshini was found missing from 29.07.2021 for which, he lodged a complaint before the second respondent on 01.08.2021. The said Pandi called the petitioner through her mobile phone at 2.15 p.m. on 09.08.2021 and informed that his wife was not interested to live with him and she married one Karthi, she is now living in Chennai. This information was furnished by the petitioner to the second respondent on 23.08.2021. Inspite of sharing the above information, the second respondent is harassing the petitioner to come to Chennai to trace the above said Priyadharshini.

3. The learned Additional Public Prosecutor would submit that for the purpose of tracing the above said Priyadharshini, this petitioner was enquired, since she has not been secured so far. https://hcservices.ecourts.gov.in/hcservices/ 1/2

In view of the above, the second respondent is at liberty to record further statement of the petitioner except for the above said purpose that the petitioner has to come to Chennai for the purpose of tracing the above said Priyadharshini, which may not be appropriate. At the same time, the petitioner is directed to co-operate with the second respondent to complete the investigation.

5. With these observations, this Criminal Original Petition stands disposed of.
