PRAYER :- For Bail in Crime No.1247 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/accused, who was arrested and remanded to judicial custody on 28.08.2020 for the offences punishable under Sections 294(b), 324 and 302 of IPC on the file of the respondent police seeks bail.
2. The learned Additional Public Prosecutor made a submission that the accused had attacked his father and he died and a case has been registered under Section 302 of IPC and investigation is in progress. The murderous attack happened due to some family dispute between the two daughter-in-laws. The accused son supported one daughter-in-law and attacked his own father with wooden log, which resulted in the death of his father.
3. This Court is of the considered opinion that investigation is still in progress and granting of bail at this point of time would cause prejudice to the free and fair investigation to be conducted by the police officials. Thus it is not the appropriate situation to grant bail to petitioner. In these circumstances the https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.12567 of 2020 respondent police is duty bound to investigate the matter at the earliest possible and file charge sheet.
4.The learned counsel for the petitioner reiterated that the petitioner is innocent and he had no intention to attack his own father. Thus the case of the prosecution is a false one. 5.In view of the fact that the family dispute was already prevailing and the investigation is also in progress it would not be appropriate for this Court to consider the present bail petition at this point of time.
6.Hence the petition stands dismissed.
