PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 3rd respondent not to interfere with the Civil Dispute and thereby harass the petitioner in respect of the Tipper Lorry bearing Registration No.TN 48 AZ 7565. 1/4

ORDER

This Criminal Original Petition has been filed to direct the 3rd respondent not to interfere with the Civil Dispute and thereby harass the petitioner in respect of the Tipper Lorry bearing Registration No.TN 48 AZ 7565.

2. The learned counsel for the petitioner would submit that the fourth respondent namely Priyadharshini purchased the vehicle on hire purchase agreement from the petitioner's company. Later he failed to pay the installments. So the above said vehicle was repossessed by the petitioner's company and sold to one third party by following due procedure. But however, the transfer document was also signed by the fourth respondent. Inspite of that, after lapse of four years, this petition has been filed.

3. The learned Additional Public Prosecutor would submit that enquiry was undertaken on the basis of the complaint given by the fourth respondent. During the course of enquiry, both sides appeared and finding that a proper complaint has been given by the fifth respondent making some allegation that after the above said repossession agreement between the petitioner's company and the fourth respondent, the above said property was handed over to fifth respondent.

4. Whatever it may be, it is a factual issue. The complaint given by the fifth respondent has also been closed after enquiry. With the above said observation, nothing survives for further consideration or direction in this matter.

5. In the result, this Criminal Original Petition stands disposed of. 20.06.2023 NCC :
